1. Acceptance of Terms
By accessing this website (mywork.makeitnice.world and associated subdomains), submitting a contact form, requesting an estimate, booking a service, or engaging Jeremy Kidder ("we," "us," or "our") for any work, you ("Client" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use this site or engage our services.
These Terms apply to all services we provide, including home improvement and property maintenance services, and web design, software development, and digital services.
2. Services Offered
2a. Home Improvement & Property Services
Jeremy Kidder provides home improvement, repair, and maintenance services in the Colorado Springs area, including but not limited to:
- Interior and exterior painting and finishing
- Deck construction, repair, and refinishing
- General home repairs and maintenance
- Power washing, gutter cleaning, and other express services
- Custom projects as agreed upon
2b. Web Design & Software Development Services
We also provide digital services including but not limited to:
- Website design and development
- Custom web application and software development
- Website hosting and ongoing maintenance
- Search engine optimization (SEO) and digital marketing
- Domain management and technical consulting
All services are subject to availability. We reserve the right to modify, discontinue, or update service offerings at any time.
3. Estimates, Quotes, and Pricing
- All estimates provided through this website, by email, by phone, or in person are non-binding unless confirmed in a written agreement, proposal, or invoice signed or accepted by both parties.
- For home improvement services, final pricing may vary based on actual project scope, materials, site conditions discovered during the work, and any change orders requested by the Client.
- For web/software services, project scope and pricing will be defined in a written proposal or statement of work. Changes to scope after approval may result in additional charges.
- Prices displayed on offer or service pages represent standard pricing and are subject to change without notice.
- We will communicate any significant price changes or cost overruns before proceeding with additional work.
4. Booking, Scheduling, and Project Timelines
Home Improvement Services
- Submitting a contact form or booking request does not constitute a confirmed appointment.
- Appointments are confirmed only when you receive a confirmation communication (email, text, or phone call) from us.
- We aim to respond to all inquiries within 24 hours during business days.
- Cancellations should be made at least 24 hours in advance when possible.
- Weather, material availability, and other factors beyond our control may affect scheduling. We will communicate any delays as soon as possible.
Web/Software Services
- Project timelines are estimated in the proposal or statement of work and may vary based on scope complexity, Client feedback turnaround, and third-party dependencies.
- Timely Client feedback and asset delivery (content, images, credentials, etc.) is required to maintain project timelines. Delays in Client deliverables may extend the project timeline proportionally.
- Significant delays in Client responsiveness (30+ days without communication) may result in the project being placed on hold and may require a reactivation fee to resume.
5. Payment Terms
General
- Payment terms are agreed upon before work begins and specified in the proposal, invoice, or written agreement.
- We accept payment via credit/debit card, ACH/bank transfer, check, cash, and online payment platforms as agreed.
- Online payments processed through Stripe are subject to Stripe's Terms of Service.
Home Improvement Services
- For projects over $1,000, a deposit of up to 50% may be required before work begins, with the balance due upon completion.
- For smaller projects, payment is due upon completion unless otherwise agreed.
- Materials costs may be billed separately and may require advance payment.
Web/Software Services
- Projects are typically structured with milestone-based payments (e.g., 50% upfront, 50% upon completion) or monthly retainers, as specified in the proposal.
- Ongoing hosting and maintenance services are billed monthly or annually as agreed.
- Work product will not be transferred, deployed to production, or released to the Client until all outstanding invoices are paid in full.
Late Payments
- Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month (18% annually) on the outstanding balance.
- We reserve the right to suspend or halt ongoing work if invoices are more than 30 days overdue.
- For web services, we reserve the right to suspend hosting, take down websites, or revoke access to deliverables if payment is more than 60 days overdue, after providing written notice.
6. Intellectual Property
Website and Marketing Content
- All content on this website, including text, images, designs, photographs, and videos, is the property of Jeremy Kidder unless otherwise noted.
- Project photographs may include images of Client properties or completed work. We may use these images in our portfolio, website, and marketing materials unless the Client objects in writing.
- You may not reproduce, distribute, or use our website content for commercial purposes without written permission.
Web/Software Deliverables
- Client content: All text, images, logos, and other content provided by the Client remains the Client's property.
- Custom work product: Upon full payment, the Client receives ownership of custom designs, custom code, and custom content created specifically for their project, unless otherwise specified in the proposal.
- Pre-existing materials: We retain ownership of any pre-existing code, frameworks, libraries, templates, components, or tools that we bring to the project or that were developed independently. The Client receives a perpetual, non-exclusive license to use these materials as part of their delivered project.
- Third-party assets: Any third-party software, plugins, fonts, stock images, or services used in the project remain subject to their respective licenses. We will inform the Client of any third-party dependencies and their licensing requirements.
- Portfolio rights: We retain the right to display completed web/software projects in our portfolio and marketing materials, including screenshots and descriptions, unless the Client objects in writing due to confidentiality requirements.
7. Warranties and Workmanship
Home Improvement Services
- We stand behind our work. Workmanship issues reported within 90 days of project completion will be addressed at no additional charge.
- This warranty covers defects in our workmanship only, not normal wear and tear, damage caused by the Client or third parties, acts of nature, or pre-existing conditions that were disclosed before work began.
- Material warranties are provided by the manufacturer and are separate from our workmanship warranty. We will pass through any applicable manufacturer warranties.
Web/Software Services
- We warrant that web/software deliverables will substantially conform to the specifications described in the approved proposal or statement of work.
- Bug fixes for defects in our custom code will be provided at no additional charge for 30 days after project delivery/launch ("warranty period").
- This warranty does not cover issues caused by Client modifications, third-party integrations not specified in the original scope, changes to third-party platforms or APIs, hosting environment changes not managed by us, or acts beyond our reasonable control.
- Beyond the warranty period, bug fixes and updates are available under a maintenance agreement or at our standard hourly rate.
8. Client Responsibilities
Home Improvement Services
- Provide safe, reasonable access to the work area.
- Disclose any known hazards, structural issues, or conditions that may affect the work (e.g., lead paint, asbestos, mold, electrical issues).
- Obtain any required permits or HOA approvals, unless we have agreed in writing to handle permits.
- Secure or relocate personal property in the work area before work begins.
Web/Software Services
- Provide required content, assets, credentials, and feedback in a timely manner.
- Designate a single point of contact authorized to make decisions and approve deliverables.
- Review and provide feedback on deliverables within the timeframes specified in the project plan.
- Maintain your own backups of any content or data you provide to us.
- Ensure that any content you provide does not infringe on third-party intellectual property rights.
9. Revisions and Change Orders
Home Improvement Services
Changes to project scope after work has begun must be communicated and agreed upon. Significant changes may result in adjusted pricing and timeline, which will be communicated before additional work proceeds.
Web/Software Services
- The project proposal specifies the included scope, including the number of revision rounds (typically 2 rounds of revisions).
- Additional revision rounds or changes to the approved scope constitute a change order and may incur additional charges.
- Change orders will be documented in writing (email is acceptable) with the associated cost and timeline impact before work proceeds.
10. Cancellation and Termination
By the Client
- You may cancel or terminate a project at any time by providing written notice (email is acceptable).
- Upon cancellation, you are responsible for payment for all work completed to date, materials purchased, and any non-refundable expenses incurred.
- For web/software projects, deposits are non-refundable once work has begun, as they compensate for reserved time and resources.
By Us
- We reserve the right to terminate a project if the Client fails to make payments when due, is unresponsive for 30+ days, requests work that is unethical or illegal, or creates an unsafe or hostile work environment.
- If we terminate, we will provide any completed work product (for which payment has been received) and refund any payments for work not yet performed.
11. Limitation of Liability
- This website is provided "as is" without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of this website or our services, including but not limited to loss of profits, data, business opportunities, or goodwill.
- For home improvement services, our total liability for any claim is limited to the amount paid by the Client for the specific project giving rise to the claim.
- For web/software services, our total liability for any claim is limited to the total fees paid by the Client for the specific project or the preceding 12 months of service fees (for ongoing services), whichever is greater.
- We are not liable for delays, interruptions, or failures caused by factors beyond our reasonable control, including weather, pandemics, supply chain disruptions, third-party service outages, or internet disruptions.
- We carry appropriate general liability insurance for our home improvement service operations.
12. Indemnification
You agree to indemnify and hold harmless Jeremy Kidder from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Content you provide that infringes on third-party intellectual property or violates any law.
- Your use of delivered web/software products in a manner not contemplated by the original scope.
- Your failure to disclose material information about work site conditions (for home improvement projects).
- Any dispute between you and your own customers or end users that relates to work we performed for you.
13. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of a project, including but not limited to business plans, financial information, login credentials, trade secrets, and unpublished project details. This obligation survives the termination of the business relationship.
14. Offers and Promotions
- Special offers, packages, and promotions displayed on this site are valid while published and may be withdrawn at any time.
- Offers cannot be combined unless explicitly stated.
- Specific terms and conditions may apply to individual offers and will be noted on the offer page.
15. Customer Portal
We may provide you with access to a customer portal for project tracking, messaging, document sharing, and other collaboration features. By using the portal:
- You agree to keep your login credentials secure and not share them with unauthorized persons.
- You are responsible for all activity under your portal account.
- Portal access may be suspended or terminated upon project completion, non-payment, or violation of these Terms.
- Your use of the customer portal is also subject to our Privacy Policy and Cookie Notice.
16. User Conduct
When using our website, customer portal, or communication channels, you agree not to:
- Submit false, misleading, or fraudulent information.
- Attempt to access unauthorized areas of the site or systems.
- Use automated tools to scrape, crawl, or overwhelm the site.
- Submit content that is unlawful, threatening, abusive, or harassing.
17. Third-Party Links
Our site may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of those sites. Visiting linked sites is at your own risk.
18. Governing Law and Disputes
- These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
- Any disputes arising from these Terms, our services, or your use of this website shall first be attempted to be resolved through good-faith negotiation.
- If negotiation fails, disputes shall be resolved in the state or federal courts located in El Paso County, Colorado.
- You agree to submit to the personal jurisdiction of these courts.

Continued use of the site or our services constitutes acceptance of updated Terms. For active projects, the Terms in effect at the time of the signed proposal or agreement will govern that project.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions remain in full force and effect.
